What happens if a tenant does not leave after an eviction order?
If the tenant does not leave, the eviction order must be enforced through the Sheriff’s Office. Landlords cannot remove the tenant themselves. The Sheriff is the only authority who can legally carry out the eviction.
How do I enforce an eviction order in Ontario?
You must file the eviction order with the Court Enforcement Office (Sheriff) and follow the required steps for enforcement. This includes submitting the proper documents and waiting for the Sheriff to schedule the eviction.
How long does it take for the Sheriff to enforce an eviction?
Timelines vary depending on the region and backlog. In some areas, it may take a few weeks or longer. Acting quickly after receiving your order can help minimize delays.
Can I change the locks if the tenant is still in the unit?
No. Even with an eviction order, only the Sheriff can legally remove the tenant and restore possession to the landlord. Changing the locks yourself can result in legal consequences.
What happens on the day of the eviction?
The Sheriff will attend the property, require the tenant to leave, and return possession of the unit to you. After enforcement, you can legally secure the unit.
Do you help with enforcing eviction orders?
Yes. We assist landlords with the steps required to move enforcement forward, including guidance, documentation, and coordination to help you regain possession as efficiently as possible.
